SANTA BARBARA, Calif. -

The family of a man shot and killed by a Santa Barbara Police officer in Sept. has announced plans to file a $10,000,000 wrongful death lawsuit.

District Attorney Joyce Dudley found the shooting of Brian Tacadena justified.
Investigators said in a report that the 46-year-old was high on meth and had meth hidden inside a knife.

Relatives said he had a history of mental illness and could have been subdued with less than lethal force.

They also question reports that the patrol car video recorder was broken.

The Tacadena family plans to file the suit against the Police Department and the city of Santa Barbara.
