SAN LUIS OBISPO, Calif. -

A San Luis Obispo County Jail inmate diagnosed with the H1N1 flu virus has passed away, according to the San Luis Obispo County Sheriff's Office.

Rudy Silva, 35, passed away Monday afternoon at Sierra Vista Medical Center, but the exact cause of death is pending. Silva was a transient and booked for petty theft and possession of a controlled substance.

Jail staff is taking steps to protect themselves and inmates from the flu by offering flu shots and testing new inmates coming into the jail.
