Victim's Family Blames Metrolink for Not Using Available Safety Measures
The family of one of the youngest victims of Friday's Metrolink crash says Metrolink is to blame for not using available rail safety features.
The family of 19-year-old Aida Magdaleno has just filed a claim against Metrolink . Camarillo resident Aida Magdaleno was on her way to the Moorpark station to meet her mother on Friday when the Metrolink and a freight train collided. Magdaleno usually sat on the last Metrolink car but her brother says on that day she sat on the first car. The Magdaleno Family is the first of possibly many to file a claim against the transit agency which is a procedural step before filing a wrongful death lawsuit . Beverly Hills attorney Paul Kiesel is representing the family. He says Metrolink could've prevented the accident if the commuter train had been equipped with Positive Train Control. The advance technology applies the brakes to override human error. Keisel says Metrolink's insurance covers disasters but it's too soon to be talking about punitive damages. While the cause of the crash is still under investigation the wheels are already in motion to compensate the Magdaleno's for their loss. |
